John Sutter had it made, raising cattle and sheep on a huge land-grant ranch in the Sacramento Valley of California. But a carpenter building a mill for Sutter got distracted by something shiny in the stream. What glittered was a few flakes of gold, which ruined everything Sutter had built by starting the gold rush of 1849.

Hundreds of miners dreaming of instant riches squatted on Sutter’s land. He couldn’t throw them off because there was no local law to back him up and his own men had all quit. No one wanted to work for wages anymore when they could go broke panning for gold.

Sutter went to the courts and then to Congress for help in getting rid of the 49ers. Even though he had clear legal title to the land and the miners had none, Sutter lost—his rights, his title, eventually his ranch. Private property, it turns out, was yours until it wasn’t.
